Terms of Service

• QoreDB: refers to the software project, the website, the documentation, the associated tools and services.

• User: any person accessing the site or using the QoreDB software.

• Software: the QoreDB software, distributed under an open-core model.

• Site: the official QoreDB website.

• Publisher: Raphaël Plassart, sole trader (French *micro-entreprise*), SIRET 942 906 157 00014, publisher and operator of the QoreDB website and software.

The purpose of these ToS is to define the conditions under which users can access the QoreDB site, consult the documentation, use the resources made available, and operate the QoreDB software.

Access to the QoreDB site is free of charge, unless otherwise indicated. QoreDB reserves the right to:

• suspend, restrict, or interrupt access to the site or any service,

• modify the content or features offered,

• perform maintenance operations.

No guarantee is given regarding the continuous availability of the site or services.

The QoreDB software is distributed under an open core model, with a dual licence:

• the core of the software is published under the Apache 2.0 licence: free to use, modify, redistribute and use commercially, royalty-free;

• a set of advanced (Premium) features is published under the Business Source License 1.1: source-available, free for personal and internal business use, no competing commercial offering allowed, with automatic conversion to the Apache 2.0 licence four years after each release.

Every source file carries an SPDX header declaring the applicable licence. In the event of any discrepancy between this summary and the licence files published in the official repositories, the latter prevail.

The Team licence is granted per seat. It grants as many named seats as the number of seats purchased, at the rate of one (1) licence key per person.

• each seat key is tied to its holder's email address,

• sharing a key among several people is prohibited,

• using the software beyond the number of purchased seats is prohibited.

The subscription holder (administrator) assigns the seats and ensures compliance with these terms within their organisation. Any breach may result in the suspension or termination of the licence.

Paid licences (Pro, Team) are sold by the Raphaël Plassart micro-enterprise.

• payments are processed exclusively by Stripe (Stripe Payments Europe, Limited); QoreDB has no access to any card data,

• prices are shown in euros, without VAT — VAT not applicable, Article 293 B of the French General Tax Code,

• the invoice is issued and made available by Stripe once payment is complete,

• the licence key is delivered by email after payment confirmation,

• subscriptions renew automatically for the subscribed period and can be cancelled at any time from the Stripe customer portal, cancellation taking effect at the end of the current period.

Under Article L221-28 of the French Consumer Code, a consumer who requests immediate delivery of their licence key waives their right of withdrawal once the service has been fully performed. Any question regarding a payment or a refund can be sent to the contact address indicated on the website.

The user agrees to:

• use QoreDB in accordance with applicable laws and regulations,

• not infringe on the security, integrity, or proper functioning of the site or the software,

• not attempt unauthorized access to systems or data,

• not use QoreDB for fraudulent, illegal, or abusive purposes.

Any abusive use may result in the suspension of access to services.

All elements of the QoreDB site (texts, documentation, graphics, logo, visual identity) are protected by intellectual property rights. Unless otherwise stated, any unauthorized reproduction, representation, or exploitation is prohibited. The source code of the QoreDB software is subject to the terms of the applicable license, as defined in the License page.

QoreDB is provided "as is", without warranty of any kind. QoreDB cannot be held liable for:

• direct or indirect damages resulting from the use of the site or software,

• data loss, business interruption, or commercial damages,

• consequences related to improper configuration or use of the software.

The user is solely responsible for their use of QoreDB and the data they process.

Personal data processing is governed by the Privacy Policy accessible on the QoreDB site.

The QoreDB site may contain links to third-party sites or services. QoreDB exercises no control over these services and declines all responsibility regarding their content or functioning.

QoreDB reserves the right to modify these ToS at any time. Users are invited to regularly consult the current version. The date of the last update is indicated at the top of the page.

These ToS are governed by French law. In the event of a dispute, and failing amicable resolution, the competent courts will be those of the applicable jurisdiction in accordance with the legislation in force.
